About this form

The Office of the Australian Information Commissioner (OAIC) can grant extensions of time to agencies who are processing Freedom of Information requests.

This form can be used by agencies to request an extension of time to process an FOI request or to notify an agreed extension of time.

Please note that if an agency does not provide the Information Commissioner with adequate reasons, the extension of time request may be refused.

An agency may apply to vary the extension if an earlier extension granted by the OAIC is insufficient, however the agency must explain what has changed since the initial extension of time request and provide reasons for why a variation to the extension is justified.

Please also explain the reasons for the request and why an extension would be justified. Requests for longer extensions of time (more than 30 days) will require greater justification.

Please provide a timeline setting out the work already completed in order to process this request. Where an extension of time has previously been granted, describe the work that was undertaken during that extended period. *

  • 15 June 2026 – FOI request received and assessed as a significant matter due to the anticipated complexity of searches and consultations required.
  • 18 June 2026 – Preliminary search and retrieval consultation sent to the relevant business area to identify and locate documents within scope.
  • 19 June 2026 – Response received from the business area advising that some documents had previously been released and were publicly available on the Department’s disclosure log.
  • 24 June 2026 – Applicant contacted and provided with copies of the disclosure log documents. The applicant was also invited to consider revising the scope of the request, and a request was made for an extension of time under s 15AA.
  • 3 July 2026 – Further response received from the business area, including the provision of some documents within scope. The business area advised that documents dating prior to 2015 could not be located despite searches undertaken. Given the age of the records, an additional business area was identified and consulted to determine whether it may hold, or be able to locate, any relevant documents.
  • 5 July 2026 – Applicant responded, declining the proposed s 15AA extension of time and providing further clarification regarding the scope of the request.

What work is required to finalise the request? *

In order to finalise the request, the NDIA must:

  • obtain and review additional material provided by relevant business areas, including historical records, to ensure all documents within the clarified scope of the request have been identified and captured;
  • undertake further searches and follow-up consultations with additional business areas to determine whether documents predating 2015 can be located and retrieved;
  • collate and verify documents received from multiple business areas to ensure searches have been comprehensive and that all relevant material has been identified;
  • conduct a comprehensive review of all documents located to determine their relevance to the request and identify any duplicate material;
  • undertake detailed line-by-line assessments of the documents to identify sensitive information and assess the potential impact of disclosure;
  • assess and apply any relevant exemptions under the FOI Act;
  • undertake consultation with relevant internal stakeholders to confirm sensitivities, potential harms arising from disclosure, and the appropriateness of any proposed redactions;
  • consider information provided by business areas to ensure the decision is informed by all relevant considerations;
  • prepare a decision and detailed statement of reasons in accordance with the requirements of the FOI Act.

Why is the request considered complex or voluminous? *

The request is considered complex and voluminous for the following reasons:

  • The request relates to historical records spanning a significant period of time, requiring searches across multiple business areas

  • to identify, retrieve and assess relevant material.
  • Documents within scope date back to a period prior to 2015. Due to the age of the records, additional searches and consultations are required to determine whether relevant documents can be located and retrieved.
  • The scope of the request was clarified during processing, requiring further searches and reassessment of records held across relevant business areas.
  • Documents have been sourced from multiple NDIA business areas, requiring coordination across the Agency to identify, retrieve and assess relevant material.
  • Some documents within scope have previously been released and are published on the disclosure log. Additional assessment is required to determine the relevance of those documents to the revised scope and whether further material exists.
  • The documents contain information that requires detailed review to determine relevance to the request, identify duplicate material, and assess whether any exemptions under the FOI Act apply.
  • The nature and age of the records require consultation with relevant business areas to verify search outcomes, confirm the completeness of searches undertaken, and address any gaps in the information located.

Please describe the measures that would be taken to ensure a decision is made within the period of the requested extension and to keep the applicant informed of the progress of the request *

If the requested extension is granted, the NDIA will take the following steps to ensure the request is finalised within the extended timeframe:

  • Searches and consultations with relevant business areas will be prioritised to ensure all potentially relevant documents are identified, retrieved and provided for assessment as soon as possible.
  • Regular follow-up with business areas will be undertaken to monitor the progress of outstanding searches, particularly in relation to historical records and documents predating 2015.
  • Documents will be reviewed on a progressive basis as they are received, allowing assessment work to commence immediately rather than awaiting the completion of all searches.
  • Ongoing engagement with relevant stakeholders will be undertaken to resolve any issues affecting the identification, retrieval or assessment of documents in a timely manner.
  • The applicant will be kept informed of the progress of the request, including updates on the status of searches and any significant developments that may affect the processing of the request.
