| Title | Critical Incidents | |
| Purpose | This document is part of a suite of guidance documents for Case Managers to use in formulating their approach to managing individual matters before the Administrative Review Tribunal (ART). This Guide has been developed to support Case Managers to respond quickly to Critical Incidents that occur during the course of an ART proceeding. A critical incident arises when one or more of the following occurs, in relation to a participant or a prospective participant: - an unexpected death, or a death that occurs in the connection with the provision of NDIS supports or services - serious injury - abuse or neglect - unlawful sexual or physical contact, harassment, or assault - sexual misconduct committed against, or in the presence of, the participant or prospective participant – including grooming for sexual activity - unauthorised use of a restrictive practice - threatened or attempted self-harm or suicide |

| Policy statement | NDIA staff have a primary responsibility to ensure the safety of the participant, prospective participant and others when notified of a critical incident. | NDIA staff also have an obligation to report all critical incidents to the Participant Critical Incidents team by completing a Critical Incident Notification Form, and by sending the completed form (as a Microsoft Word document) to the Participant Critical Incidents team at participantincidents@ndis.gov.au. | ||
| Participant Critical Incidents team | The Participant Critical Incidents team will provide advice, and work with Case Managers to relation to remedial pathways and next steps. The Participant Critical Incidents team will also record critical incidents in PACE. Please note, only basic information is to be recorded by the CM in LEX due to personal privacy and sensitivity concerns. |

| Staff wellbeing | Where a critical incident arises, Line Managers are responsible for ensuring the health and wellbeing of the employees within their team. Where necessary, Line Managers should encourage their team to take up the range of support services available to them. | My Wellbeing (intranet) |
| Other considerations | Issues of confidentiality may not arise in relation to the sharing of personal information with relevant state authorities, where doing so may prevent or lessen a threat to a person’s life, health, or safety – as the primary concern is the safety and wellbeing of the participant or prospective participant. Where a participant or prospective participant passes away, and their death is not unexpected or is not in connection with the provision of NDIS supports and services, you will instead notify the Bereavement Support Team. |
