Title Critical Incidents
Purpose This document is part of a suite of guidance documents for case managers to use in formulating their approach to managing individual cases before the Administrative Appeals Tribunal (AAT).
Scope This Guide has been developed to support Case Managers to respond quickly to Critical Incidents that occur during the course of an AAT proceeding.

A critical incident arises when one or more of the following occurs, in relation to a participant or a prospective participant:

- an unexpected death, or a death that occurs in connection with the provision of NDIS supports or services
- serious injury
- abuse or neglect
- unlawful sexual or physical contact or assault
- sexual misconduct committed against, or in the presence of, the participant or prospective participant, including grooming for sexual activity
- unauthorised use of a restrictive practice
- threatened or attempted self-harm or suicide

Current National Disability Insurance Agency (NDIA) policy on the subject NDIA staff have a primary responsibility to ensure the safety of a participant or prospective participant and/or others when notified of a critical incident. If the participant or prospective participant and/or another person is in immediate danger or harm, or requires urgent assistance, contact emergency services immediately.

NDIA staff also have an obligation to report all critical incidents by completing a Critical Incident Notification Form, and sending the completed form (as a Microsoft Word document) to the Participant Incident central inbox: participantincidents@ndis.gov.au.

NDIA Posture in relation to this subject The Critical Incidents Team will provide advice and work with AAT Case Management staff in relation to remedial pathways and next steps. The Critical Incidents Team will also record critical incidents in CRM. Note: Only basic information is to be recorded in LEX due to privacy and other issues.

When a critical incident arises, Team Leaders are responsible for ensuring the health wellbeing of the employees within their team and should refer their team to the full breadth of support services available.

Other considerations Issues of confidentiality in relation to the sharing of personal information with relevant state authorities in this context may not arise where there is a significant threat of injury or death, as the overriding concern is providing support to the participant or the prospective participant.

Where a participant or prospective participant passes away, but their death is not unexpected or is not in connection with the provision of NDIS supports and services, you will instead notify the Bereavement Support Team.
