Dear Committee Members,

I am writing to express my strong support for the concerns and recommendations raised by Sam Paior in her submission regarding the proposed NDIS Future Generations Bill 2026. After reviewing her submission, I share the view that while the long-term sustainability of the NDIS is important, many aspects of the proposed legislation risk causing significant harm to participants, families, carers, nominees and providers if implemented without stronger safeguards.

In particular, I support the recommendations to:

 Protect participants from sudden funding cuts without consultation or review rights, especially social and community participation supports which are critical to inclusion and wellbeing.

 Maintain timely review and access decision-making processes, rather than extending timeframes from 21 days to 90 days during periods of crisis or urgent need.

 Ensure the legislation continues to recognise the “whole person” and does not narrow supports through restrictive wording changes such as the addition of “directly”.

 Preserve participant choice and control as a central principle of the NDIS rather than allowing cost containment to dominate decision-making.

 Recognise lived experience, family context and professional evidence when determining reasonable and necessary supports.

 Improve transparency, accountability and review rights, particularly where automated decision-making and computer-generated budgeting tools may increasingly affect participants.

 Ensure all participants can genuinely understand and engage with the NDIS through mandatory Easy Read materials and accessible communication.

I am particularly concerned that many of the proposed changes appear to shift risk and burden onto participants and families, including unpaid carers and nominees, without sufficient procedural fairness, transparency or safeguards. I also share concerns about the breadth of ministerial powers proposed and the limited oversight available for significant rule changes.

Like Sam Paior, I support a sustainable NDIS that can continue for future generations. However, sustainability must not come at the expense of safety, dignity, inclusion, choice and fairness for people with disability.

I urge the Committee to carefully consider the recommendations outlined in Sam Paior’s submission and to strengthen the legislation before it proceeds further.
