Submission to the National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Bill 2026 inquiry and report

Dear Committee Secretary,

Please accept my following submission to the inquiry, in response to the National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Bill 2026, which directly addresses the provisions of the bill.

I request that my name be withheld. I am an NDIS participant, as is my child. We’re both autistic, have experienced developmental delays, including delayed speech, mild hearing loss, and auditory processing difficulties. Our experiences at a young age and supports available have been vastly different, though not without significant effort. Without NDIS, my child would not have the support to be included in the community.

The proposed bill seeks to define functional capacity in exclusion of the impact of a person’s environmental and personal circumstances. Additionally, the bill seeks to do so through the provision of rules that are yet to be written. This definition seems to be an attempt to exclude the social model of disability, leaving people impaired by their environment to fend for themselves, excluded from NDIS support.

I remind the secretary of the United Nations Convention on the Rights of Persons with Disabilities Article 19 b., which states that: “Persons with disabilities have access to a range of in-home, residential and other community support services, including personal assistance necessary to support living and inclusion in the community, and to prevent isolation from the community.”

Implementing the proposed changes, without alternative supports in place, will severely jeopardise our ability to live and be included in the community. And my child would face significant delays in engaging with peers, developing essential life skills, and participating in society.
