I am writing as an addendum to my prior submission to state that the proposed legislation should not allow the Minister to cut whole categories of support rather than looking at a persons needs in addition to listening to clinical evidence provided to ndia. The proposed legislation also weakens review rights which is an inappropriate part of any legislation.
In particular it is necessary to ensure psychology is not removed as a whole category from support through ndis. My statements below reflect that this proposed legislation has already been put into effect by planners with removal of supports particularly psychology.
As a background, I’m a late 50’s female with multiple physical disabilities ( as listed on access for ndis )who is unable to work.
My change of circumstances reassessment meeting a month ago led to a planner halving my previous physical therapies funding and removing psychology as a support ( which I’d had since Sept 2022).
I was moved from the old system to PACE . I was NOT provided an impairment statement which participants were meant to receive which further makes the point of which impairments planner now deemed didn’t warrant the required funding as per clinical evidence. No justification given for her decisions.
For background, planner from Tasmania ndis office, came to the mutually organised reassessment meeting by phone, with a plan already set out , there was no enquiry to me, no discussion, no explanation or reasoning, just a voice to what she had decided in advance.
“ You are not going to like this bit” explained before stating that psychology was being removed as a support I could claim . stated that NDIS don’t pay for psychology. I replied that was not accurate and that a FOI on my file showed prior planner notes stating I could continue to have psychology funded due to suitable psychology report evidence. ignored my communication and did not change her position. Planner then seemingly proceeded to diagnose me with a mental health condition because the most recent psychology report mentioned low mood and anxiety, however I am not on ndis for psychosocial reasons. My psychology report also explicitly indicated that the ndis support was for capacity building of a degenerative condition and had been used for capacity building. A mental health plan is not for chronic condition disability , yet ignored my statements of why I was not eligible for that.
There was no offer of a step down approach or minimal funding to conclude appointments with the psychologist which is a very dangerous position for NDIS to be putting participants in after years of psychological support.

Each report I provided as solid clinical evidence stated the risks to me and my physical disability if the required resources were not funded. Planner and the senior planner must not have taken this seriously or potentially not fully read reports.
My support coordinator has warned me not to put in an internal review because participants are getting even further cuts “ if you get a less nice planner”!! How does this build any trust in the agency or any trust in this proposed legislation without significant changes!”
I reiterate whole supports should not be removed arbitrarily as part of this proposed legislation.
