Dear Senator,

Thank you for taking the time to carefully examine the National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Bill 2026. I am writing to ask that you use the extended Senate inquiry to thoroughly scrutinise this Bill and either vote against it or insist on significant amendments before it returns to Parliament. The NDIS was founded on the principle of providing individualised supports based on need. That commitment should not be replaced by hidden caps, broad ministerial powers, automated decision-making, and funding reductions that leave people without the supports they need to live safely, independently, and with dignity. While community advocacy has led the Government to agree to some amendments, serious concerns remain. The Rules and key legislative instruments have not yet been released, the public has not been given access to the modelling showing who will be affected, and people still do not know what practical supports will be available outside the NDIS if their access or funding is reduced. This is not a minor administrative matter. When supports are reduced before appropriate alternatives are in place, the need does not disappear—it is shifted onto families, carers, hospitals, crisis services, and already overstretched community systems. People may lose independence, become socially isolated, experience declining health, or be forced to rely on informal care arrangements that are neither realistic nor sustainable. I respectfully ask that you oppose this Bill unless it is amended to:

  • Prevent the Minister from imposing caps on essential NDIS supports under section 33(2EA), including caps on funding, support intensity, frequency, duration, and worker-to-participant ratios.

  • Remove or substantially amend section 34A so the Minister cannot impose broad, across-the-board reductions to community participation, therapy, and capacity-building supports.

  • Release the Rules, key legislative instruments, and any budget algorithms or automated decision-making tools before any parliamentary vote.

  • Publish clear impact modelling outlining who will be affected and how.

  • Ensure that no person is removed from the NDIS, or has essential supports reduced, before genuine, funded, and enforceable alternatives are available.

  • Protect fair, accessible, and effective review rights.

  • Safeguard participant choice and control over supports and providers.

  • Require genuine co-design with people with disability, families, carers, and representative organisations. The NDIS must be sustainable, but sustainability cannot be achieved by making the scheme less fair, less transparent, or less safe. Reform should address the genuine challenges within the system—including fraud, poor market design, and inconsistent decision-making—without disadvantaging people with disability or removing the supports that enable them to participate fully in everyday life. People with disability deserve certainty, transparency, and a fair process. Parliament should not be asked to vote on major reforms before the community has had the opportunity to see the Rules, understand the modelling, and assess the safeguards that will be put in place. Please use the extended inquiry to listen to people with disability and ensure this Bill is properly amended before it returns to Parliament. Thank you for representing our community. Kind regards,
