National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Bill 2026

To the Senate Community Affairs Legislation Committee,
My name is Briarley and I am an NDIS participant. I am a 28-year-old woman living with psychosocial disabilities. It is important to me that the NDIS Amendment (Securing the NDIS for Future Generations) Bill 2026 does not pass in its current form because I rely on the help I get from the NDIS to live a healthier life than the one I had before I became an NDIS participant, indeed, a life I could never build or maintain if I were unsupported.
One part of this Bill I find particularly concerning is Schedule 1 Access and Planning Measures Part 4 Support Determinations Section 34A (5a and 5b). I am concerned about the implications of these provisions because, as I understand it, it will be lawful for someone who is not a qualified health professional (the Minister) to make decisions that will effectively deny a disabled person’s access to adequate supports. To say that the reasonable and necessary supports in a participant’s plan will no longer have to be fully funded is not only an inappropriate response to provider fraud, it will severely reduce participants’ quality of life and increase risks to our safety. I myself certainly wouldn’t be able to supplement support costs, this would leave me without the assistance I need to live my life independently which would greatly worsen my mental and physical health.
I have a life today because of the help I receive from the NDIS, so I am asking the Senate Community Affairs Legislation Committee to please remove this part of the Bill and consult with participants, providers and health professionals to reach a more appropriate solution before making any cuts to participant funding.
