I’m the Branch Manager of the Complaints Management and Freedom of Information (FOI) Branch at the National Disability Insurance Agency (NDIA). About the role

The APS4 Information Access Officer is a team membership position that will work within defined parameters relating to their area of responsibility. The role will be required to apply well-established policy, principles, practices and procedures to achieve outcomes that supports and contributes to NDIA’s objectives to “build a world-leading National Disability Insurance Scheme”.

The role will be required to provide operational and administrative support that is informed and directed by sound knowledge in Freedom of Information (FOI) requests and information access areas and may undertake some research and analysis activities.

The APS4 Information Access Officer will have a considerable level of contact with internal and external stakeholders and will be required to communicate with and provide advice on a range of matters to resolve moderately complex enquiries.

Duties include:

  • Preparing and collating documents required to make FOI decisions in accordance with the FOI Act.
  • Preparing and collating documents required to make PIA decisions in accordance with the PIA scheme.
  • Preparing and drafting a range of other material including data reports, briefing material and correspondence.
  • Providing administrative support to develop systems, processes and practical tools including training to support FOI and PIA handling and awareness.

(NOTE: the key responsibilities of the role are based on current priorities and may change over time).

Desirable skills, experience and qualifications

Previous experience working within the FOI Act (or state/territory equivalent), ‘access to information’ processes, as well as administrative decision making under statutory frameworks is highly desirable.

Valuable skills and experience in roles across the public sector include:

  • Excellent communication and stakeholder engagement skills
  • Strong analytical skills with ability to apply critical thinking, research and data literacy
  • Clear Time management skills with demonstrated ability to prioritise and manage your own workload to comply with timeframes, while maintaining attention to detail

About the area

The Information Access team consists of:

  1. Triage and Early Resolution assesses all incoming information requests made via both PIA scheme and under the FOI Act. The team provides guidance to applicants about alternate resolution pathways, works with applicants to obtain additional information, and registers requests on administrative systems to enable speedy processing by the case management teams.
  2. Personal Information team handles PIA requests and all FOI requests that seek access to personal information. This team includes a Complex Personal FOI team, responsibilities include consultation with relevant stakeholders, identifying appropriate exemptions and making decisions about releasing agency information while ensuring transparency and compliance with FOI legislation.
  3. Non Personal Information team process and manage FOI requests from the public seeking access to agency documents, such as policies, procedures, statistics and other administrative records. Responsibilities include consultation with relevant stakeholders, identifying appropriate exemptions, and make decisions about releasing agency information while ensuring transparency and compliance with FOI legislation.

  1. Case Management team works to maintain the standard and quality of FOI casework in line with legislative obligations and NDIA values.

Eligibility information

To be eligible for employment with the NDIA, you must meet certain conditions before your employment can begin. These are set out within the Public Service Act 1999. Requirements include:

Eligibility information

To be eligible for employment with the NDIA, you must meet certain conditions before your employment can begin. These are set out within the Public Service Act 1999. Requirements include:

  • Employment Suitability Check/Police Check – this includes the ability to obtain and maintain an Australian Government security clearance, at the Negative Vetting 1 level. We will arrange this for you, if you are successful in getting a job.

About the role

The APS6 Information Access Officer is accountable under limited direction to undertake complex work that is guided by legislation, policies, procedures, standards, methodologies and precedents. The position will assist the team in the coordination of Freedom of Information (FOI) requests made to the Agency and will ensure the Agency meets its legal obligations in relation to the Freedom of Information Act 1982 (Cth) [FOI Act].

The position will assist the team with Participant Information Access (PIA) requests made to the Agency and contribute to the development of the Agency’s information handling requirements. The APS6 Information Access Officer will be a delegate FOI and PIA decision-maker and will make robust FOI decisions.

The APS6 Information Access Officer is a team leadership position within the NDIA and will have delegated authority and responsibility to resolve issues and risks across a range of activities. The role is required to provide leadership, control, planning, resource management, performance management and decision making for the Team Membership within the work area.

The position will have a considerable level of public contact in relation to complex, difficult or sensitive issues. It is required to liaise with a range of internal and external stakeholders in a representational role on behalf of the branch/division/NDIA.

Duties include:

  • Assisting and making FOI decisions on complex matters in accordance with the FOI Act.
  • Maintaining clear and concise records of case management actions and outcomes, including contributing to necessary data capture
  • Managing the priorities of clients and available resources to deliver results on time and within budget.
  • Preparing and contributing to a range of other material including briefing material for Ministers. Board papers, media releases, reports to Parliamentary committees, and correspondence.

About the area

The Information Access team consists of:

  1. Triage and Early Resolution assesses all incoming information requests made via both PIA scheme and under the FOI Act. The team provides guidance to applicants about alternate resolution pathways, works with applicants to obtain additional information, and registers requests on administrative systems to enable speedy processing by the case management teams.
  2. Personal Information team handles PIA requests and all FOI requests that seek access to personal information. This team includes a Complex Personal FOI team, responsibilities include consultation with relevant stakeholders, identifying appropriate exemptions and making decisions about

releasing agency information while ensuring transparency and compliance with FOI legislation. 3. Non Personal Information team process and manage FOI requests from the public seeking access to agency documents, such as policies, procedures, statistics and other administrative records. Responsibilities include consultation with relevant stakeholders, identifying appropriate exemptions, and make decisions about releasing agency information while ensuring transparency and compliance with FOI legislation. 4. Case Management team works to maintain the standard and quality of FOI casework in line with legislative obligations and NDIA values. 5. About the role

The EL1 Assistant Director Information Access role is required to provide leadership, control, planning, resource management, performance management and decision making for the FOI team in the IRPLO Branch.

The role will be required to coordinate and assume responsibility for highly complex or sensitive FOI matters, a high-volume workload and the supervision of several teams.

Responsibilities of the role include but are not limited to:

  • Leading the team in making decisions on various matters in accordance with the FOI Act.
  • Supporting the FOI team and legal services team to manage Information Commissioner reviews.

About the area

The Reviews and Information Release Division (RIRD) is responsible for the operation of the Internal Review Branch, the External Review Branch, and the Information Release, Privacy, and Legal Operations Branch. The Acting General Manager, RIRD, is Daniel Flowers.

The Information Release, Privacy and Legal Operations Branch (IRPLO) is responsible for providing operational support and uplifting capability through the management of all recruitment and procurement, learning and development, continuous improvement, strategy and reporting, legal operations, and communications and engagement activities. The Branch also manages the FOI and PIA teams as well as Agency Privacy Incident Management functions of the Agency

The Information Access, Freedom of Information (FOI) team manages the Agency’s FOI and PIA functions to ensure compliance with statutory timeframes and will practice build the function to improve Agency knowledge and contributes insights to improve the participant experience. The team is also responsible for the Agency’s management and response to complaints and external review requests made to the Office of Australian Information Commissioner (OAIC).

About the role

The National Disability and Insurance Agency (NDIA) is seeking candidates to fill the role of EL2 Director Information Access.

The EL2 Director Information Access is accountable under broad direction to undertake work with a high level of complexity or sensitivity that delivers quality outcomes within the Information Release, Privacy & Legal Operations Branch in the National Disability Insurance Agency (NDIA).

The position is an important team leadership position within the NDIA and will have delegated authority and responsibility to resolve issues and risks across wide- ranging activities of substantial depth involving significant detail. The role is required to provide leadership, control, planning, resource management, performance management and decision making for the team membership and assigned Contractors working within the work area.

The EL2 Director Information Access will exercise a significant degree of independence and will use a high level of decision-making and judgement. The role will be required to coordinate and assume responsibility for highly complex or sensitive FOI matters, a high-volume workload and the supervision of several teams.

Responsibilities of the role include but are not limited to:

• Strategically managing the Freedom of Information and PIA teams including the provision of high-quality services to the Agency staff and executives.

• Providing advice on complex FOI matters in accordance with the FOI Act.

• Providing advice and making FOI internal review decisions where necessary.

• Working with the FOI team and legal services team to manage Information Commissioner reviews.

• Preparing and contributing to a range of materials, including weekly reports, quarterly reports for the Office of the Australian Information Commissioner and briefing material for Ministers and Estimates hearings.

About the area

The Reviews and Information Release Division (RIRD) is responsible for the operation of the Internal Review Branch, the External Review Branch, and the Information Release, Privacy, and Legal Operations Branch. The Acting General Manager, RIRD, is Daniel Flowers.

The Chief Counsel Division (CCD) is responsible for supporting the Agency to deliver on its priorities for the benefit of NDIS participants. It assists the Agency to act lawfully, and ensure legal risks are managed. The CCD consists of Agency Legal Services Branch, Scheme Legal and Legislation Services Branch, and Dispute Resolution and Litigation Branch. The Chief Counsel is Tom McGregor.

The Information Release, Privacy, and Legal Operations (IRPLO) Branch is responsible for providing operational support and uplifting capability to both the RIRD

and Chief Counsel Divisions through the management of all recruitment and procurement, learning and development, continuous improvement, strategy and reporting, legal operations, and communications and engagement activities. The Branch also manages the Agency’s Freedom of Information, Participant Information Access, and Agency Privacy Incident Management functions.

The Information Access, Freedom of Information (FOI) team sit within the IRPLO branch and manages the Agency’s Freedom of Information (FOI) and Participant Information Access (PIA) functions to ensure compliance with statutory timeframes and will practice build the function to improve Agency FOI knowledge and enable the branch to contribute insights that can improve the participant experience. The branch is also responsible for the Agency’s management and response to complaints and external review requests made to the Office of Australian Information Commissioner (OAIC)
