Instrument of Delegation 2 of 2021

I, MARTIN HOFFMAN, Chief Executive Officer of the National Disability Insurance Agency, REVOKE a) National Disability Insurance Scheme Act 2013 Instrument of Delegation 1 of 2020 signed on 21 September 2020, and all variations made to that Instrument and b) National Disability Insurance Scheme Act 2013 Instrument of Delegation 1 of 2021 signed on 31 May 2021.

DELEGATE c) the powers and functions under the National Disability Insurance Scheme Act 2013 described in the tables in Schedule 1 to Agency officers in the positions identified in the tables in Schedule 11

The delegation of powers and functions set out in Schedule 1 is to be read subject to Schedule 2 and Schedule 3. The delegation of powers and functions in this instrument is subject to any limitations set out in the tables in Schedules 1, 2 and 3. This instrument of delegation remains in force until it is revoked and replaced by another instrument.

For the avoidance of doubt, if there is a change in the name of a role title, Branch, Division or Group, the relevant delegations will continue to apply and may be exercised by those officers who perform roles substantially similar to those performed by the delegates listed in this Instrument prior to the change of name taking place.

Instrument of Delegation update

This week I approved the revised Instrument of Delegation 2 of [Delegation icon. ] 2021, which empowers more staff to make delegate decisions on my behalf across key functions, such as access, planning and reviews. Giving these greater decision-making powers supports timely and accurate decision-making for participants as well as more manageable workloads for delegates.

The Instrument of Delegation needs to be updated from time to time to ensure it reflects changes to the Agency’s structure, roles, titles and permissions under the NDIS Act.
