Before You Start
Impairment categories information, called ‘Notice of impairments’ in section 32BA of the NDIS Act. A participant can apply at any time for changes their impairment category status—adding or removing an impairment is included within this scope; however, terminology varies between legal documents (‘vary’) versus public communication (‘change’). Any alteration necessitates a delegate decision as per Section 4(1)(a) (the Act). The determination on varying these details falls under reviewable decisions outlined similarly elsewhere (”Section”). The case involves deciding if altering current impairment categorization aligns with guidelines:
- Our Guideline: Applying to the NDIS includes sections regarding outcomes after making such determinations and weighing evidence related disabilities;
Articles referenced include:
- Impairment Categories Guide,
- Descriptions of Impairment Categories,
- Understanding Highly Likely & Commonly Associated Impairment Categories.
