- Introduction
1.1 Purpose
This procedure outlines the process of referring a matter to Pre-ALOC for guidance and support around the most appropriate course of action to progress a matter before the Administrative Review Tribunal (ART), and/or to ensure that the matter is ready to proceed to ALOC for further decision. This procedure also outlines the process of referring a matter to the Appeals and Litigation Oversight Committee (ALOC) for final determination on whether to proceed to a substantive hearing before the Tribunal, or on the most appropriate course of action to progress the matter.
Approval from ALOC is required to proceed to a substantive hearing.
1.2 Scope
This procedure applies nationally across the External Review Branch (ERB), the Dispute Resolution and Litigation Branch (DR&L), and the Information Release, Privacy and Legal Operations Branch (IRPLO), and is to be used by: • Pre-ALOC and ALOC Secretariat • Director, ART Case Strategy • Case Managers (CM) • Internal Legal Officers (ILO)
1.3 Roles and Responsibilities
The roles and responsibilities set out in the Standard Operating Procedure: Document Control apply also to this procedure.

Case Managers are required to verbally provide the following information when presenting a matter to Pre-ALOC: s22(1)(a)(ii) - irrelevant material
o whether further evidence is yet to be provided by the participant, prospective participant, or Independent Expert Clinician (IEC). s22(1)(a)(ii) - irrelevant material

3.1.4 Pre-ALOC meeting outcomes
Pre-ALOC will provide guidance in relation to the most appropriate course of action to progress the matter, including whether: s22(1)(a)(ii) - irrelevant material
additional information is required to inform the Agency position. This may include engaging an Independent Expert Clinician (IEC), or seeking additional advice from TAPIB (as determined by Pre-ALOC); s22(1)(a)(ii) - irrelevant material s22(1)(a)(ii) - irrelevant material
