As an NDIS participant, and sole parent to two other NDIS participants - one child, other adult, I have some serious concerns about the proposed new laws. For context we have no informal supports.

Firstly I have three disabilities, all which meet access requirements, and all having different substantial effects on my functioning. If I am correct, it appears under the new rules a person will only receive funding for one disability. The supports I need for one disability (psychosocial) are completely different to the supports I need for my physical disability. Therefore if my ‘main disability’ is considered to be psychosocial then I won’t be able to get my wheelchair which is needed for my physical condition. If that is my primary disability then I won’t get supported for my need to be accompanied in the community. And how will they separate my psychosocial impacts from my Autism ones when there is so much overlap?

My second concern is around parental responsibility. I have a 9 year old who cannot go into the community due to her disability without 1-1 support. She is home-schooled for this very reason. When I go into the community I need 1-1 supports as does my child. I physically cannot catch her when she absconds up hills or towards the road. I physically cannot enter all parks where birthday parties may be. I cannot get in the pool with her, take her down on the beach or to events. Not every place is wheelchair accessible. My daughter has been declined community participation funding due to ‘parental responsibility’. Whilst I can be nearby I cannot do these activities with her, and my support worker will be supporting me. Are we to expect my child will never be able to leave the house? No school due to disability and no community access at any other time either? How is that going to affect her development and future scheme needs? I run a responsible parent, I do a good job raising my daughter. The Department of Child Services would have no reason to remove her from my care. Yet due to my disability and hers, she will never be able to access the community . This is what happens when ‘parental responsibility’ Is not considered in context.

I hope these situations will receive due consideration when deciding on the new laws.
