- Care paid in previous three years before entering NDIS ($37K).

- Calculation made seven years after accident causing disability; about
$14 kper year over plan period;- Yet calculated reductions intended:

$250 K) which is vastly more than actual receipt and leaves zero care funding remaining under current plan.

Budgeting For Care And Fund Management
Carefully budgeted funds but now will be taken away due to reduced plan amount until next review of plans.
At time accepted negotiated settlement was informed that I must pay back NDIS $37.8K, retaining ongoing funding.
Objection Process Rejected Without Explanation On Special Consideration Rights
When receiving the compensation figure could raise objection given guidelines provided by NDIS team at acceptance stage (which rejected outright); special circumstances for requesting special consideration not fully explained prior submission request.
Legislation And Fairness In Compensation Reductions
The legislation allows me a fair process if inadequate advice from lawyer or NDIS was not provided during negotiations, it’s grossly unfair calculating reduction including legal costs without adequate representation.
There needs to be human consideration on each case according individual impact recognized rather than an AI calculation tool.

The ndis has a mandate to not duplicate costs for care, so the figure I actually received for care is the figure that would be fair to use. Instead they have taken away care costs and made me pay twice in effect for fighting to reduce the financial burden on them
The ndis compensation team is incredibly difficult to access and very inconsistent. At one point after calling the national reception line I was informed that ndis had no such office. My response was “yes there is;I am holding a letter from them”; I had to speak two supervisors, it took week get any communication from the compensated team.
The effect now worse off after fight years compensate.During time also had NDIS attend AAT tribunal.even though diagnosed as treatable many varied specialists.I acquired brain injury widely recognised treated.
Was required submit more reports justify my scheme then when did clearly read.The paper trail followed misinterpreted.So even significant disability fought every could barely look myself-At son quit job become carer frail thought’d die.Had several experiences symptoms stroke.Yet public servants life living hell.Community nurse visit year yet her advocacy ignored.
Struggled used own funds many years.ndis repaid support included legal cost has effect paying them twice.
Creates fear inconsistency constant politicising all shonky providers middle class professionals over diagnose service structure Macmedico menu one size fits effective or not.

Submission 192 - Supplementary Submission The compensation guidelines need to be clear and accessible and that department needs to be consistent and accessible. The calculation of reduction should be for care only and only during the period it’s relevant to. The ndis legislation and funding need to be consistent and independent of which political ideology is in government
