Dear Committee Secretary,

I’m writing to share my concerns about the National Disability Insurance Scheme Amendment (Securing the NDIS for Future Generations) Bill 2026.

I understand the need to prevent fraud and ensure the NDIS is sustainable, but I’m worried that some parts of the Bill could negatively affect the rights and safety of people with disability.

In particular, I’m concerned about:

  • Narrower definitions of “functional capacity” and “permanence”,
  • Increased use of standardised assessments,
  • Reduced flexibility within plans,
  • Expanded NDIA powers without sufficient safeguards. I’m especially worried about the impact on autistic children, including those with Pathological Demand Avoidance (PDA) profiles, whose support needs can fluctuate and are often misunderstood in rigid assessment systems. Children with PDA are frequently suspended or excluded from school and are over-represented in youth justice systems. NDIS supports are therefore critical to the well being of PDA children and their families. I am also worried the carer strain will fall back to the Mum and the NDIS will reflect unintentioned ableism and misogyny.

We already face huge barriers across education, health, and disability systems. For PDA children, NDIS supports are essential and can help prevent serious mental health decline, school can’t, and family breakdown. What happened to the families in WA and NSW is real, and it could happen again.

Furthermore, the consultation period for reforms of this size, is not long enough.

I strongly encourage the Committee to protect individualised supports, and ensure reforms are genuinely co-designed with the disability PDA community.
