Dear Committee Secretariat,

I have Traumatic Brain Injury. Please contact me if you require clarification. Please accept this formal submission to the Inquiry into the National Disability

Insurance Scheme Amendment (Getting the NDIS Back on Track No. 1) Bill

  1. This submission addresses Schedule 1, Item 11 (New Section 33(2A)) regarding the requirement that funding must be managed in accordance with the NDIS supports rules, and Schedule 2, Item 15 (Section 182) regarding provider debts and compliance guidelines. I submit this file as a definitive case study of wide-scale systemic NDIS fraud, Legislation text manipulation, and external corporate capture occurring within the Agency’s automated templates and intermediary networks. The internal checks and balances have completely failed because both internal and external entities arguably gain from systematic text manipulations, manufactures and exclusions.

EXECUTIVE SUMMARY: EVIDENCE OF SYSTEMIC TEMPLATE FRAUD & SYSTEMIC

FISCAL WASTE

This submission provides direct evidence of wide-scale NDIS systemic fraud, Legislative text manipulation, and external corporate capture occurring within the NDIA’s automated communication templates and intermediary networks. This operational framework actively squanders more public funds than it purports to save through four distinct channels:

  1. Systemic Template Manipulation: My attached Table of Discrepancies logs 128 separate instances - including 2x15 repeats where an automated backend template manually alters and falsifies the verbatim text of the NDIS Act 2013 (eg systematically deleting the statutory word “generally” and removing “for the Participant”) to manufacture unauthorised blanket bans against all planner approved therapies and treatments, for example claiming the National Law for Medical Regulation AHPRA is selectively wrong.

  2. The ‘Discard-and-Delete’ Intermediary Practice: External commercial Plan Managers are actively destroying and deleting incoming clinical billing Statements before they hit participant dashboards. This ad-hoc destruction of financial data hides data breaches, protects private software contracts, and completely blocks the participant’s statutory right to review.

  3. Exorbitant Taxpayer-Funded Overhead Leakages: Enforcing these corrupted templates wastes millions in public funds on predatory corporate consulting fees, un-appealable litigation blockades at the Tribunal, and hundreds of hours of funded Support Coordination billing lines spent on redundant administrative paperwork and put it back on the unmanned conveyor belt to nowhere.

  4. Downstream State Emergency Costs: Starving high-risk participants of historically funded clinical therapies and baseline consumables forces immediate physical collapse. This directly shifts the financial burden

onto the public sector, as participants flood state-funded emergency departments and acute hospital beds at a cost of thousands of dollars per night to manage entirely preventable medical crises. If they survive.

  1. The Community Breach of trust: This amounts to a profound Robodebt style abuse of the imbalance of power of the most vulnerable by the most powerful and a Breach of Trust which may never be recovered. That is a cost. Who is Responsible?
  • Who is Responsible Internally: The ultimate administrative responsibility for allowing these corrupted templates rests directly with the NDIA Executive Leadership Team. The internal checks and balances are entirely broken because the executive branch uses internal review delegates to rubber-stamp template rejections, protecting their automated software rollout from scrutiny to meet artificial budget reduction targets rather than correcting data errors.

  • Who is Responsible Externally: The external responsibility lies with predatory global management consulting firms, private IT software providers, and corporate health monopolies who stand to make millions from these cutbacks. Mainstream corporate allied health organisations make immense profits by capturing the market; by using templates to wipe out independent, AHPRA-registered clinicians, billions in state funding are automatically funneled away from participant choice and straight into the mainstream corporate healthcare grid.

  • Intermediary Data Fraud Under Section 182 (The ‘Discard-and-Delete’ Practice): The integrity measures under Section 182 must be expanded to penalize financial data destruction occurring outside the NDIS among

commercial Plan Management intermediaries. My Support Coordinator

has confirmed that my private Plan Manager does not maintain an unbroken record of submitted claims, actively discarding and deleting incoming clinical billing statements to hide their administrative exposure and avoid logging formal system declines. This fraudulent data destruction completely blocks the participant’s statutory right to review, creating an un-appealable financial blockade that leaves high-risk participants facing active malnutrition and medication deprivation.

  • Defiance of Central Executive Orders: My attached FOI Internal Records prove that local branches operate in direct defiance of central leadership. On 11 July 2024, a formal Ministerial directive (SID148) issued explicit instructions to fund my treatments under line item 15_056_0128_1_3. Despite this high-level

order, local software layers and private intermediaries have completely blocked fund processing. Mandatory Amendments Requested to Prevent Universal Template Fraud:

  1. Independent Audit of Automated Templates: Amend Schedule 1 to establish an independent regulatory audit body to inspect all backend PACE and CRM communication templates to ensure no unauthorized policy filters or automated “fake excuse” scripts are used to override the text of the Act.

  2. Intermediary Data Penalties: Amend Schedule 2, Section 182 to strictly penalize external Plan Managers who destroy or discard incoming participant invoice metadata.
